The "Qatarization" of Jobs in the Private Sector

Qatar has followed the footsteps of the UAE and Saudi Arabia in enacting an independent legislation (law) introducing the framework for the nationalization of jobs within establishments of the private sector operating in the State. Law No. (12) of 2024, On the Nationalization of Jobs in the Private Sector, was published in October, and will come into force (6) six months following its publication date.

The new law applies to all establishments, companies, and institutions of the private sector. Only companies and businesses affiliated with Qatar Energy or engaged in petroleum operations are exempted from its application. The law aims to prioritize the hiring Qatari nationals, and the children of Qatari women, as employees within these establishments; and only when there are "suitable" Qatari candidates, the establishment may hire expats.

 

The new law introduced the foundation and requirement of nationalization (or Qatarization). However, the Ministry of Labour is expected to establish a detailed Qatarization plan for private-sector jobs. The plan will determine the percentages Qatari employees within any sector. It will also provide guidance on the classification of employees, identifying the required positions, and setting the proper training and onboarding processes and policies for Qatari nationals seeking jobs within the private sector.

 

Incentives (may include financial rewards) for companies complying with Qatarization requirements - once enforced - have been outlined in the Law.

 

The new law is set to come into force on 16 April 2025. Until then, it is anticipated that the MOL will issue further clarifications, guides, and regulations on the application of the Qatarization plan for the private sector.
